Organizer: Lauretta’s Art Adventures, LLC, a Wyoming Limited Liability Company (“Organizer”)

This Participant Liability Waiver & Release (“Waiver”) applies to participation in The Porto Fine Art Textile Residency (the “Residency”), organized by Lauretta’s Art Adventures, LLC, a Wyoming Limited Liability Company (“Organizer”).

1. Acknowledgment of Risk and Responsibility

While every reasonable measure is taken to ensure the safety and well-being of all participants during the Residency, the Organizer cannot control all circumstances or third parties involved. I acknowledge and agree that my participation is voluntary and that I am solely responsible for my own safety, behavior, and decision to participate.

I certify that I am 18 years of age or older and that I am responsible for choosing to participate based on my own health, fitness, and abilities. I understand that all services, accommodations, and activities provided in connection with the Residency are subject to the laws and regulations of Portugal.

2. Role of Organizer and Third Parties

I understand and agree that Lauretta’s Art Adventures, LLC acts as an agent for independent suppliers providing accommodations, transportation, meals, studio facilities, and related services connected to the Residency.

Such services are subject to the terms and conditions of those suppliers. The Organizer, its agents, representatives, employees, and assigns accept no liability for injury, damage, loss, accident, delay, or any other incident that may result from the act, negligence, or default of any supplier, person, or entity engaged in providing these services.

3. Participant Health and Medical Responsibility

I agree that I am ultimately responsible for my own health and well-being, including carrying with me any necessary medications for chronic conditions, allergies, or other medical needs.

I understand that it is my responsibility to disclose to the Organizer any medical or psychological conditions that may affect my participation.

The Organizer reserves the right to request that I refrain from participation in certain activities if, in its judgment, participation could pose a risk to myself or others.

4. Disclaimer of Guaranteed Results

Although the techniques, methods, and instruction provided during the Residency are designed to be effective and beneficial, each participant arrives with unique experience levels, creative styles, and inherent abilities.

As a result, the Organizer makes no representation or guarantee that any specific level of artistic proficiency, skill acquisition, or creative outcome will be achieved. Each participant understands and agrees that their progress and results depend on their own effort, engagement, and practice.

5. Assumption of Risk and Release of Liability

I understand that participation in the Residency may involve risks, including but not limited to international travel, physical activity, and the use of tools or materials. I voluntarily assume all such risks, known and unknown, and release and discharge the Organizer, its members, employees, contractors, agents, and assigns from any and all claims, demands, causes of action, or liability arising from or related to my participation in the Residency, except to the extent caused by the Organizer’s gross negligence or willful misconduct.

6. Media Release

I grant permission for the Organizer to photograph or record me during the Residency and to use such images or recordings for promotional or educational purposes, without compensation. (Participants may opt out by notifying the Organizer in writing before the start of the event.)

7. Governing Law

This Agreement shall be governed by and construed in accordance with the laws of the State of Wyoming, United States of America, without regard to its conflict of law principles.

8. Venue

Any disputes arising from or related to participation in The Porto Fine Art Textile Residency shall be resolved exclusively in the state or federal courts located in Wyoming, USA.

9. Acknowledgment and Acceptance

By signing below (or by checking the acknowledgment box on the registration page), I confirm that I have carefully read this Participant Liability Waiver & Release, understand its terms, and agree to be bound by them. I understand that this document affects my legal rights and that I sign it voluntarily.
